The judge has discretion. The statutes, procedures, case law, and rules of court provide flexibility.
Cite the cases. Quote the statutes. Follow the rules. Break the rules. None of it guarantees the result. Even when the answers appear obvious, the path to a dispositive ruling is mired in, and tangled by. . . judicial latitude.
Stay focused. Act reasonably. Make no fatal mistake.
